It has been announced that UK private rented sector (PRS) landlords could face a 5 year prison sentence if they fail to conduct proper ‘Right to Rent’ checks included in new Government proposals for the Immigration Bill

The proposed changes to legislation will require PRS landlords to verify the immigration status of all prospective tenant applicants, before tenancies are agreed. Any landlord who repeatedly fails to conduct these checks would be in breach of a new offence, carrying maximum penalties of five years’ imprisonment or a fine.

The Government passed a law back in 2013 requiring private rental sector (PRS) landlords to provide smoke alarms in all UK rental properties.

However, this new bill is still under public consultation and as yet it has not been brought into force and some local authorities claim that this is putting tenant’s lives at risk.

Now there are further calls from the fire service for more new laws to be introduced to make sure all landlords, both social and private sector, install smoke alarms in all rented properties.

Mandatory smoke alarms are among the key issues to be discussed at the Local Government Association’s (LGA) annual fire safety conference due to be held in Gateshead next month 10th – 11th March 2015.

The call for UK landlords to install smoke alarms in rental properties forms a central part of the LGA’s key report ‘The Fire and Rescue Service: Making our Nation Safer’, which was launched on Saturday 7th February 2015.

The report highlights a series of proposals on how UK fire services can improve fire safety for tenants, including calls for electrical wiring in rented properties to be inspected annually, the same way UK PRS landlords are obliged to obtain gas safety certificates (CP12’s) every year.

There are always plenty of stories in the media about landlords and letting agents and their idiosyncratic practices, but a recent news article about a German landlord published in The Telegraph and picked up by LandlordToday.com really does take the p**s!

UK landlords have faced a great deal of criticism for reasonably, and in some cases unreasonably, withholding a tenants’ deposit for all kinds of damage caused to rental property by tenants but now a German landlord has ended up in court for trying to claim damage to a bathroom floor caused by a tenant’s urine.

The landlord had withheld €1,900, equivalent to around £1,400 (GBP) from the tenant’s €3,000 deposit for damage allegedly caused to a marble floor in the bathroom of a rental property by a male tenant missing the toilet bowl while urinating standing up.

The tenant sued his landlord after the refusal to pay back the €1,900 claimed for damages to the marble floor but the judge ruled that the tenant had the right to take care of business standing up.

The landlord had brought in a “technical expert“, who had the unenviable task of confirming that wayward droplets were indeed the cause of the damage to the marble tiles.

Currently, the liability of private rented sector landlords to pay council tax for their unoccupied rental properties varies from region to region across the UK. Some local councils do not allow exceptions from their normal rules and even if a rental property is unoccupied, the landlord must pay council tax.

This does not even begin to become fair in any way, shape or form as the rental properties are not financially draining council funds, nor are they a burden on any other council run services as bins are not being emptied and there should be no need for any of the emergency services to be called upon.

The National Landlords Association (NLA) have recently been contacting all UK local authorities to request council tax exemptions for private rental sector landlords whose rental properties become empty between tenancies.

The task is being carried out by the NLA’s 37 regional representatives who operate across the UK in order to campaign at a local level.

Many local authorities will soon to be drafting their budget proposals for the next financial year, and the NLA are keen to negotiate the much needed council tax exemptions for landlords now.

According to a newspaper report published in The Independent last week, around 10% of private rental sector tenants have suffered ill health in the last 12 months because they feel that rogue landlords had failed to deal with poor conditions in their rental properties.

Housing and homelessness charity Shelter and British Gas commissioned a survey of 4,500 private rented sector tenants and reckon that poor living conditions are commonplace for tenant families in the UK’s private rented sector.

Around 50% of the tenants surveyed said they had lived in a rental property with damp or mould in the past year, and 20% of tenants said their rented home has electrical hazards, while 17% of tenants reported living with pest infestations including mice, ants and cockroaches.

Campbell Robb, Shelter’s chief executive, said “No family should have to live in a home that puts their health and well-being at risk, let alone face eviction just for asking their landlord to fix a problem. Yet every day, we hear from parents up and down the country living in fear that damp or gas and electrical hazards are putting their children in danger, but feeling powerless to do anything about it. With a bill to end revenge evictions going through parliament next month, we now have a real chance to change the law and protect renting families. We’re calling on people across the country to email their MPs and ask them to vote to end this unfair practice once and for all.”

Mystery Of Missing £400,000 Housing Benefit Payments

R2R Company Owes Landlords £400,000 Housing Benefit Payments

Around £400,000 (GBP) in housing benefit payments have mysteriously disappeared after being paid to London Housing Solutions one of London’s biggest property agents, who specialise in letting property to tenants claiming benefits, Channel 4 News have revealed.

Channel 4 News attempted to trace both the present and former directors of the company, who admitted that the money had gone astray, but neither would accept responsibility for its disappearance.

Local Housing Solutions, an offshoot of London Housing Solutions, who until recently shared offices and staff in Catford also denied benefiting from the missing payments.

Channel 4 News understands at least 100 private rented sector landlords are owed rent by London Housing Solutions and the tenants spoken to by Channel 4, fear eviction as a result of the non payments.

The two rent 2 rent companies were originally set up by Keith MacGregor, who failed to respond to Channel 4 News’ accusations.

Average UK residential property prices for 2014

are estimated to be 2.3% higher than in 2007

Forecasts from the Centre for Economics and Business Research (CEBR) suggest that a typical residential property in the UK will cost an average of £227,000 (GBP) in 2014, overtaking the average peak price of residential property observed at the height of the housing bubble in 2007, for the first time.

The CEBR also predict that the average residential property price will be £222,000 (GBP) by the end of this year, 1.4% higher than average property prices reached in 2012.

By 2018, the CEBR expect the cost of a typical residential property in the UK to average £267,000 (GBP).

In 2014, the CEBR estimate that the Government’s Help-to-Buy scheme could raise UK property prices by up to 0.8% without having any appreciable impact on the current housing supply.

However, if the upward trend in residential property prices continues, it could lead to an additional 4,800 residential properties being built in 2015.

UK residential property values have seen the first monthly rise since three months ago.

A new report by mortgage lender Nationwide found that UK property valuations showed a modest increase of 0.3% in May compared with previous months, after April’s figures recorded a 0.3% fall.

The low volume of residential properties up for sale is sustaining the price increase, according to the mortgage lender.

UK property valuations are still 0.7% lower than they were this time in 2011, meaning the average asking price is £166,022.

This reduction is smaller than the 0.9% year-on-year drop recorded in March and April, said the Nationwide.

Robert Gardner, chief economist at Nationwide said “Demand for homes remains subdued on the back of weak labour market conditions, but the lack of homes coming on the market is providing support for prices. This is in part a reflection of the low rate of building in recent years which has failed to keep pace with household formation”.

The mortgage lender’s findings also showed that consumer demand for residential property outweighs the supply due to rising rent costs as a result of people staying in rented accommodation in the PRS because they are unable to raise the deposit or secure a mortgage to purchase a home of their own.
